1. A. Because of variable hydrologic conditions, differences in well construction, depth, and size, and the irregular occurrence of saltwater sands, the rules, regulations and standards stated herein cannot cover every possible situation. For cases where compliance with the rules, regulations, and standards stated in this Chapter is impractical, the owner, engineer, or the water well contractor may request a variance and/or clarification on methods specified. Such requests shall be addressed to the department as follows:

2. B. The request must be in writing, must demonstrate that compliance is impractical and must outline a satisfactory alternative. The department may prescribe, in writing, alternate requirements that are equivalent to the regulations and standards stated herein relating to the protection of aquifer and prevention of ground water contamination.
