Abandoned Pools [formerly paragraph 24:028]

A.
1. 1. A pool that is not in use and/or not intended for use that presents a situation endangering the public health as deemed by the state health officer, shall be either:
  1. a. emptied;
  2. b. filled with inert material;
  3. c. covered and anchored; or
  4. d. addressed by other methods submitted to and approved by the state health officer.
2. 2. The owner and/or lessee shall jointly be held liable.
