1. A. No person shall construct any new facilities for any state agency, or construct any new institutional buildings, or make additions or substantial renovations to such existing facilities until plans and specifications therefore have been submitted to, and approved in writing by, the state health officer. Institutions include, but are not limited to the following (whether public or private):

   1. 1. schools (nursery schools, trade schools, colleges, or universities);
   2. 2. hospitals;
   3. 3. nursing homes;
   4. 4. jails; and
   5. 5. mortuaries.
