1. A. Statutory Compliance

   1. 1. Coverage of Medicaid hospice care shall be in accordance with:

      1. a. 42 USC 1396d(o); and
      2. b. the Medicare Hospice Program guidelines as set forth in 42 CFR Part 418.
2. B. In order to participate, a hospice shall maintain compliance with the Medicare conditions of participation for hospices as set forth in 42 CFR Part 418.50-418.100 and shall have a valid Medicaid provider agreement.
