1. A. Recipients who qualify for family planning services in the new categorically needy group include individuals of child bearing age who meet the following criteria:

   1. 1. women who are not pregnant and have income at or below 138 percent of the federal poverty level; and
   2. 2. men who have income at or below 138 percent of the federal poverty level.
