1. A. No reward shall be made to any person if:

   1. 1. the information was previously known to the department or criminal investigators;
   2. 2. the person planned or participated in the action resulting in the investigation;
   3. 3. the person is, or was at the time of the tip, excluded from the Medicaid program,
   4. 4. the person was subject to a recovery under this Chapter or the Medical Assistance Programs Integrity Law; or

   5. 5. the person is or was a public employee or public official:

      1. a. acting on behalf of the state; and
      2. b. who has or had a duty or obligation to report, investigate, or pursue allegations of wrongdoing or misconduct by health care providers or Medicaid recipients.
      3. c. if the person has not had such duties and obligations for two years prior to providing the information, that person is not excluded from a reward.
