1. A. Pari-mutuel wagering within the enclosure of a licensed association's facility during approved racing dates on horse races held at a race track in another state or country may be permitted by the commission. The following conditions must be met upon written application by the licensed association to the commission.

   1. 1. The horse race must be of outstanding nature and of interest to a great number of patrons.
   2. 2. The horse race must be televised regionally, nationally or internationally or by closed-circuit network, so that patrons at the association's facility may view the racing event.
   3. 3. The licensed association must submit a written agreement with the host track or association where the race is held.
   4. 4. The licensed association must submit written approval by the host racing commission or board.
   5. 5. The licensed association must submit written approval by the host track or jurisdiction's horsemen's association.
   6. 6. Application to the commission must be made at least 30 days before the racing event is to be held.
   7. 7. Notwithstanding the provisions of Paragraph 2 failure to receive the live telecast transmission of the race shall not affect wagers made and payoffs thereon.
