1. A. Contracts exceeding the amounts provided in Section 305 shall be awarded as provided for in this Chapter.

2. B. Contracts for $100,001 or more and Social Service contracts for $250,001 or more, within a 12-month period, shall be awarded in accordance with regulations issued by LED in Chapter 5 of this LPC, unless it is determined, in writing by the Secretary, that any one of the following conditions is present:

   1. 1. Sole Source Procurement. A determination by the secretary, supported by documentation, that only one source exists for the services rendered;
   2. 2. Emergency Procurement. A determination by the secretary, supported by, documentation, that an emergency exists which will not permit the delay in procurement necessitated by the RFP procedure;
   3. 3. the state legislature has made an appropriation for that particular contractor or contractors via the appropriation bill or other statutes;
   4. 4. local matching funds of greater than ten percent of the contract amount are required to be contributed by the contractor;
   5. 5. the contract is with another governmental entity or government body;
   6. 6. funds are specifically designated by the federal government for a particular private or public contractor or political subdivision.
3. C. Except that any contracts for information technology equipment, related services and software purchasing shall be governed by the provisions of Chapter 11.
