1. A. Where construction, acquisition, or operation of a building, road, dam, pipeline, or similar improvement project unexpectedly uncovers human remains that appear to fall within the purview of these regulations, the owner, his agents, or other representatives shall delay temporarily, within the specific area where human remains are encountered, all construction or maintenance activity until the following conditions are satisfied.

   1. 1. The commission is notified immediately.
   2. 2. The human remains and any vestments or other articles interred therewith are preserved and delivered to the commission or a designated deputy custodian of the commission.
   3. 3. The owner or person in charge of the construction or maintenance project cooperates with any designated representative of the commission assigned to the site to recover archaeological evidence.
