Any person subject to this code is guilty of rape of a child and shall be punished as a court-martial may direct who:

1. (1) Commits a sexual act upon a child who has not attained the age of twelve (12) years; or

2. (2) Commits a sexual act upon a child who has attained the age of twelve (12) years by:

   1. (a) Using force against any person;
   2. (b) Threatening or placing that child in fear;
   3. (c) Rendering that child unconscious; or
   4. (d) Administering to that child a drug, intoxicant, or other similar substance.
