The owner, tenant, occupant, invitee, or licensee of privately owned real property may initiate a civil action in a court of competent jurisdiction against any person, agency, or political subdivision that violates KRS 500.130(12) and may seek:

1. (1) Appropriate injunctive relief;
2. (2) Actual damages;
3. (3) Punitive damages;
4. (4) Court costs; and
5. (5) Reasonable attorney's fees.
