1. (1) Except as provided in subsection (2) of this section, KRS 365.880 to 365.900 replaces conflicting tort, restitutionary, and other law of this state providing civil remedies for misappropriation of a trade secret.

2. (2) KRS 365.880 to 365.900 shall not affect:

   1. (a) Contractual remedies, whether or not based upon misappropriation of a trade secret;
   2. (b) Other civil remedies that are not based upon misappropriation of a trade secret; or
   3. (c) Criminal remedies, whether or not based upon misappropriation of a trade secret.
