NECESSITY, FUNCTION, AND CONFORMITY:

KRS 304.2-110 authorizes the Commissioner of Insurance to promulgate administrative regulations necessary for or as an aid to the effectuation of any provision of the Kentucky Insurance Code as defined in KRS 304.1-010. KRS 304.17A-005(23)(j) authorizes the Department to promulgate an administrative regulation to determine other health care practitioners to be added to the definition of "health care provider" or "provider" for use in KRS Chapter 304, Subtitle 17A. This administrative regulation implements KRS 304.17A-005(23)(j).

1. Section 1. In addition to the health care practitioners listed in KRS 304.17A-005(23)(a) – (i), the definition of "health care provider" or "provider" in KRS 304.17A-005(23) shall include a pharmacy licensed under the provisions of KRS Chapter 315.
