CERTIFICATION STATEMENT:

NECESSITY, FUNCTION, AND CONFORMITY:

KRS 151B.035(1) and (3)(l), (m), and (o) requires the executive director of the Office of Career and Technical Education to promulgate administrative regulations for full-time and part-time certified and equivalent staff governing demotion, dismissal, suspension, and other disciplinary measures. This administrative regulation establishes procedures for dismissal, demotion, and suspension of employees.

1. Section 1. General Provision. Except as provided by KRS 151B.055(10), an employee in the unclassified service shall not have appeal rights to the Kentucky technical Education Personnel Board.
2. Section 2. Dismissals, Demotions, and Suspensions. The appointing authority or designee may make dismissals, demotions, and suspensions as required to insure effective and efficient management in the Office of Career and Technical Education.
