NECESSITY, FUNCTION, AND CONFORMITY:

Additional definition of ophthalmic dispensing.

1. Section 1. Eyeglass or spectacle frames and mountings intended for the purpose of holding corrective prescription lenses, are declared to be appurtenances thereto within the meaning of KRS 326.010. The following are ophthalmic dispensing within the meaning of KRS 326.010:

   1. (1) Fitting, adjusting, or adapting of such frames and mountings;
   2. (2) Performance of any act which involves a decision as to the size, shape, fitting or positioning of the frames and mountings in position before the eyes of the wearer; and
   3. (3) The final delivery of the complete prescription lenses, spectacles or eyeglasses frames and mountings.
