NECESSITY, FUNCTION, AND CONFORMITY:
KRS 250.081(1)(c)3 requires the director to designate the kinds of weed seed to be considered noxious in Kentucky and to establish their maximum permitted rate of occurrence in agricultural seed. This administrative regulation establishes the kinds of weed seed to be considered noxious in Kentucky and their maximum allowed rate of occurrence for the administration of the Kentucky Seed Law.
Section 1. Noxious Weed Seed.
- (1) The following kinds of weed seed shall be designated noxious in Kentucky and the maximum permitted rate of occurrence per pound of agricultural seed shall be as established in the table in this subsection. (2) Other limitations.
- (a) Seed that contains in excess of a sum total of 480 noxious weed seed per pound (subject to the limitations established in the table in subsection (1) of this section) shall be prohibited from sale in Kentucky.
- (b) There shall be no tolerance applied to prohibited noxious weed seed.
