Any person subject to this code shall be punished at the direction of a commanding officer if such person willfully and wrongfully:

1. (a) Discharges or brandishes a firearm under any circumstances that endanger a human life; or
2. (b) causes a reasonable person to be apprehensive of the potential endangerment of human life.
