1. (a) Each loan approved by the department shall be evidenced by a loan agreement signed by the secretary and an authorized official of the provider. The agreement shall be on a form approved by the department for such purposes and shall specify:

   1. (1) The loan amount;
   2. (2) the repayment schedule; and
   3. (3) other terms and conditions which may be appropriate.
2. (b) The proceeds of each approved loan shall be made available only on or after the date the client receiving the services that are the subject of the loan is actually placed with the provider.
