1. (a) 40 C.F.R. part 61 and its appendices, as in effect on July 1, 2010, are adopted by reference except for the following:

   1. (1) The following sections in subpart A:

      1. (A) 61.04;
      2. (B) 61.16; and
      3. (C) 61.17;
   2. (2) subpart B;
   3. (3) subpart H;
   4. (4) subpart I;
   5. (5) subpart K;
   6. (6) subpart Q;
   7. (7) subpart R;
   8. (8) subpart T; and
   9. (9) subpart W.

2. (b) Unless the context clearly indicates otherwise, the following meanings shall be given to these terms as they appear in 40 C.F.R. part 61:

   1. (1) The term "administrator" shall mean the secretary or the secretary's authorized representative.
   2. (2) The term "United States environmental protection agency" and any term referring to the United States environmental protection agency shall mean the department.
   3. (3) The term "state" shall mean the state of Kansas.
