Subject to the provisions of regulations 28-19-9 and 28-19-11: (A) No person may cause or permit the emission of particulate matter from any chimney stack or vent of any incinerator in excess of the following:

1. (1) Incinerators with a waste burning capacity of less than 200 pounds per hour: 0.3 grains of particulate matter per standard dry cubic foot of exhaust gas, corrected to twelve percent (12%) carbon dioxide.
2. (2) Incinerators with a waste burning capacity of 200 to 20,000 pounds of waste per hour: 0.2 grains of particulate matter per standard dry cubic foot of exhaust gas, corrected to twelve percent (12%) carbon dioxide.

3. (3) Incinerators with a waste burning capacity in excess of 20,000 pounds of waste per hour: 0.1 grains of particulate matter per standard dry cubic foot of exhaust gas, corrected to twelve percent (12%) carbon dioxide.

   1. (B) No person may cause or permit the emission of visible contaminants from any incinerator of an opacity equal to or greater than 20 percent opacity.
