1. (a) Except as provided in K.A.R. 112-6-1 et seq., all proceedings relating to the denial, suspension, or revocation of an occupation license shall be conducted in accordance with the Kansas administrative procedure act, K.S.A. 77-501 et seq.

2. (b) As used in K.S.A. 74-8816(e)(3) the phrase "qualified to perform the duties associated with the license being applied for" shall in the case of all occupation license applicants include the requirement that such applicant shall have no present or prior activities, criminal record, or reputation, habits, or associations that meet either of these conditions:

   1. (1) pose a threat to the public interest or to the effective regulation of parimutuel racing or wagering; or
   2. (2) create or enhance the dangers of unsuitable, unfair, or illegal practices in the conduct or parimutuel racing or wagering.
