Prosecutions under the Atomic Energy Act, 42 U.S.C. §§ 2272 to 2276, are subject to the requirements of JM 9-90.020 when they involve the national security. The Atomic Energy Act provides that prosecutions pursuant to it shall be commenced by the Attorney General, after he or she has notified the Nuclear Regulatory Commission. See 42 U.S.C. § 2271(c). Prosecutions brought pursuant to 42 U.S.C. § § 2272 to 2276 must be expressly authorized by the Attorney General.
