Under the Magnuson Fisheries Conservation and Management Act, 16 U.S.C. §§ 1801-1882, the Department of Justice may transfer to the National Oceanic and Atmospheric Administration (NOAA) funds forfeited by the Attorney General for violations under the Act. Assets seized for forfeiture under the Act should be deposited in the Seized Asset Deposit Fund administered by the USMS. After forfeiture, the funds may be transferred by the USMS to NOAA, less any expenses incurred by the USMS and less ten percent of the net proceeds of forfeiture, which is deposited into the Assets Forfeiture Fund.
