The United States Attorney's authority to settle land acquisition cases may not be exercised under the circumstances specified in ENRD Directive No. 2024-02, including when:
- A. For any reason, the compromise of a particular claim, as a practical matter, will control or adversely influence the disposition of other claims;
- B. A novel question of condemnation law or a question of condemnation practice and policy is presented, or for any other reason, the settlement offer should receive the personal attention of the Assistant Attorney General in charge of the Environment and Natural Resources Division; or
- C. The agency or agencies involved are opposed to the proposed closing or dismissal of a case, or acceptance or rejection of the offer in compromise.
If any of the conditions listed above exists, the matter shall be emailed for resolution to the Assistant Attorney General, Environment and Natural Resources Division, in care of the Chief of the Land Acquisition Section.
