Sec. 1. The following definitions apply throughout this article:

1. (1) "Aggravating factor" refers to any fact or circumstance surrounding a crime or violation that is sufficient to raise its severity and punishment.
2. (2) "Alcohol" has the meaning set forth in IC 7.1-1-3-4.
3. (3) "Alcoholic beverage" has the meaning set forth in IC 7.1-1-3-5.
4. (4) "Beer" has the meaning set forth in IC 7.1-1-3-6.
5. (5) "Carrier" has the meaning set forth in IC 7.1-1-3-8.
6. (6) "Certificate" has the meaning set forth in IC 7.1-1-3-8.5.
7. (7) "Certificate holder" refers to the holder of a tobacco sales certificate issued under IC 7.1-3-18.5.
8. (8) "Commission" has the meaning set forth in IC 7.1-1-3-12 and refers to the Indiana alcohol and tobacco commission established under IC 7.1-2-1-1.
9. (9) "E-liquid" has the meaning set forth in IC 7.1-7-2-10 and IC 35-46-1-1.4.
10. (10) "Electronic cigarette" has the meaning set forth in IC 7.1-1-3-15.5 and IC 35-46-1-1.5.
11. (11) "Gift" has the meaning set forth in IC 7.1-1-3-18.3.
12. (12) "Hard cider" has the meaning set forth in IC 7.1-1-3-9.5.
13. (13) "Licensed premises" has the meaning set forth in IC 7.1-1-3-20.
14. (14) "Liquor" has the meaning set forth in IC 7.1-1-3-21.
15. (15) "Minor" has the meaning set forth in IC 7.1-1-3-25.
16. (16) "Mixed beverage" has the meaning set forth in IC 7.1-1-3-26.2.
17. (17) "Mitigating factor" refers to any fact or circumstance surrounding a crime or violation that is sufficient to lessen its severity or punishment.
18. (18) "Permit" has the meaning set forth in IC 7.1-1-3-29.
19. (19) "Permittee" or "permit holder" has the meaning set forth in IC 7.1-1-3-30.
20. (20) "Person" has the meaning set forth in IC 7.1-1-3-31.
21. (21) "Primary source of supply" has the meaning set forth in IC 7.1-1-3-32.5.
22. (22) "Prosecutor" refers to the prosecutor appointed under IC 7.1-2-2-2 who is responsible for prosecuting violations of the laws, rules, and regulations enforced by the commission.
23. (23) "Public nuisance" has the meaning set forth in IC 7.1-1-3-33 and 905 IAC 1-27-2.
24. (24) "Salesman" has the meaning set forth in IC 7.1-1-3-41.
25. (25) "Special disqualifications" has the meaning set forth in IC 7.1-1-3-45 and refers to the impediments to obtaining and holding a permit set forth in IC 7.1-3-4-2 or IC 7.1-3-18.5-2.4, or both, as applicable.
26. (26) "Tobacco product" has the meaning set forth in IC 7.1-1-3-47.5.
27. (27) "Tobacco and vaping business" has the meaning set forth in IC 35-46-1-1.
28. (28) "Wine" has the meaning set forth in IC 7.1-1-3-49.
