Sec. 6. (a) The schedule of civil penalties for violations of IC 25-1-4, and the rules adopted under these laws, are as follows:

(b) In determining whether to assess a civil penalty, or the amount of a civil penalty, the board shall consider:
(1) the seriousness of the violation;
(2) any deterrent effect the civil penalty may have;
(3) any impact assessing a civil penalty may have on public confidence and trust in state government; and
(4) the mitigating or aggravating circumstances set out in subsections (c) and (d).
(c) The board shall consider the following mitigating factors when assessing a civil penalty and may adjust the amount of the civil penalty downward:
(1) Admission of violation of statutes or rules regulating the profession.
(2) Cooperation with the board's investigation or administrative process and procedure.
(3) Corrective action taken in response to notification of noncompliance or violation.
(4) History of compliance with statutes or rules regulating the profession.
(5) The extent of deviation from the statute or rule requirements.
(6) Degree of control over the events constituting the violation.
(7) Lack of material harm to the state because of the violation.
(8) The civil penalty will cause a material hardship.
(9) Carrying out reasonable precautions to prevent future violations.
(d) The board shall consider the following aggravating factors when assessing a civil penalty and may adjust the amount of the civil penalty upward:
(1) Failure to take responsibility for actions constituting a violation of statutes or rules regulating the profession.
(2) Failure to reasonably cooperate with the board's investigation or administrative process and procedure.
(3) Failure to take corrective action in response to notification of noncompliance or violation.
(4) History of noncompliance with statutes or rules regulating the profession.
(5) Failure to carry out reasonable precautions to prevent future violations.
