Sec. 2. The following minimum standards shall apply to the transportation solutions utilized by entities that run take back program or the contracted provider they use:

1. (1) An appropriate level of security that protects against diversion;
2. (2) Insurance and liability coverage similar to that maintained by common carriers or reverse distributors;
3. (3) Does not utilize a vehicle or mode of transportation that is primarily used for personal nonbusiness uses; and
4. (4) The minimum level of driver licensure required by the state to operate a commercial vehicle for business purposes.
