Sec. 5. "Grandfathered policies" means policies of the types described in section 4 of this rule that were:

1. (1) issued prior to January 1, 2015; and
2. (2) ceded, as of December 31, 2014, as part of a reinsurance treaty that would not have met one (1) of the exemptions set forth in section 15 of this rule had that section then been in effect.
