Sec. 3. If there are facts and circumstances sufficient to cause a prudent person to believe that a person:

1. (1) has been convicted of a felony in any jurisdiction of:

   1. (A) any crime of moral turpitude; or
   2. (B) a crime involving gaming;
2. (2) violated or conspired to violate either the Act or this title;
3. (3) performed any act or had a notorious or unsavory reputation that would adversely affect public confidence and trust in gaming; or
4. (4) is included on any valid and current exclusion list of another jurisdiction in the United States;

the executive director may order that the person be placed on the exclusion list.
