Sec. 5. (a) Nothing in this article requires the commission to assess a civil penalty for a violation.

(b) The commission may initiate any of the following enforcement actions for a violation instead of, or in addition to, a civil penalty:

1. (1) A disciplinary letter.

2. (2) A license:

   1. (A) denial;
   2. (B) restriction;
   3. (C) suspension;
   4. (D) refusal to renew; or
   5. (E) revocation.
3. (3) Referral for criminal prosecution.
4. (4) Referral to another appropriate agency.
5. (5) Corrective action plan.
