Sec. 3. All amusement devices, both existing and new, and all parts thereof, shall be maintained in a safe condition. All devices or safeguards that are required by this article, or the manufacturer, in an amusement ride or device when erected, altered, or repaired shall be maintained as set forth in 685 IAC 1-2-5 [675 IAC 31-2-5]. The owner, or the owner's designated agent, shall be responsible for the maintenance of amusement devices.
