Sec. 4. (a) Temporary outdoor event equipment that does not exceed twenty (20) feet above the surface of the stage or platform and that meets both of the following conditions is not subject to regulation under this article:

1. (1) For each foot of height from the ground to the highest point of the outdoor event equipment, all members of the public shall be placed an equal distance from the outdoor event equipment, plus an additional eight (8) feet.
2. (2) Except for installation and dismantling of the outdoor event equipment, no person is located within any portion or part of the outdoor event equipment.

(b) Temporary outdoor event equipment that is not subject to regulation under this article is subject to inspection by the inspection authority for compliance with the exemption in subsection (a).
