Sec. 3. The following definitions apply throughout this article:
- (1) "Building code" means the Indiana Building Code (675 IAC 13) in effect on the date that the outdoor event equipment is first installed at any location in Indiana.
- (2) "Chapters 26, 29, 30, and 31 and Section 1.2.1 of ASCE 7" means the documents incorporated by reference in 675 IAC 29-2- 2.
- (3) "Commission" means the fire prevention and building safety commission created pursuant to IC 22-12-2.
- (4) "Competent person" means an individual who, through education, training, and experience, is capable of performing the periodic inspections of outdoor event equipment required under this article.
- (5) "Division" means the division of fire and building safety of the Indiana department of homeland security created pursuant to IC 10-19-2.
- (6) "Inspection authority" means the division, the local building official authorized under IC 36-7-2-9 and local ordinance, and the local fire department authorized under IC 36-8-17-8.
- (7) "Owner" means the person that holds title to the real estate on which the outdoor event equipment is located.
- (8) "Scenic components" means decorative components of outdoor event equipment that are not directly connected to the audio, lighting, or video systems in the outdoor event equipment.
- (9) "Severe weather" means thunderstorms, tornadoes, flooding, high winds, hailstorms, or other similar, natural weather events.
