Sec. 12. (a) The division shall consider applications for design releases and plans and specifications filed under this rule. No design release shall be issued unless:

1. (1) section 5 of this rule has been complied with by the applicant; and
2. (2) the plans and specifications submitted with the application have been reviewed by the division.

(b) Subsequent to the filing of an application, the applicant may be requested to do one (1) of the following:

1. (1) Submit additional information or documents to place the application in compliance with section 5 of this rule.
2. (2) Modify the plans and specifications in order to place them in compliance with the rules of the commission.

If the applicant has not done so within thirty (30) days following the date of request, the design release shall be subject to denial by the division.

(c) The order granting or denying the design release shall be issued by the division following the requirements of IC 4-21.5-3-4. If a petition for review is subsequently granted under IC 4-21.5-3-7, the resulting administrative proceeding shall be conducted by the commission.
