Sec. 1. (a) The division of special education shall monitor all public agencies that receive federal or state monies for special education to ensure compliance with and implementation of the requirements of federal and state laws, rules, regulations, and policies regarding the provision of:

1. (1) programs;
2. (2) services;
3. (3) protections; and
4. (4) a free appropriate public education;

to all students with disabilities in Indiana.

(b) The monitoring activities may include, but are not limited to, the following:

1. (1) Complaint investigations.
2. (2) Data collection and analysis.
3. (3) State or federal fiscal audits.

4. (4) On-site reviews of the following:

   1. (A) The total special education program on a cyclical or other basis.
   2. (B) Portions of programs to examine one (1) or more issues.
5. (5) Accreditation information.
6. (6) Due process hearing decisions.

7. (7) Performance indicators measured by:

   1. (A) the state performance plan;
   2. (B) the annual performance report; or
   3. (C) other federal or state measures of performance or accountability;
8. including facilitation of parent involvement by schools.
