Sec. 62. "Mediation" means a voluntary process, described in 511 IAC 7-45-2, in which the parent and public agency attempt, with the assistance of a trained impartial mediator, to resolve a:

1. (1) complaint under 511 IAC 7-45-1; or

2. (2) dispute that has arisen in the CCC regarding:

   1. (A) the identification or eligibility of a student for services under this article;

   2. (B) the appropriateness of the:

      1. (i) educational evaluation; or
      2. (ii) student's proposed or current level of services or placement; or
   3. (C) any other dispute affecting the provision of a free appropriate public education to the student.
