Sec. 40. (a) According to the framework set forth in this rule, the board shall annually place each school corporation, school, and assessed grade span in a school and school corporation in an accountability category using letter grades A, B, C, D, and F, which correspond to the final numeric rating point ranges as set forth in subsection (b).
(b) The following scale is used to determine the accountability category placement:
(1) For an accountability year beginning with 2025-2026:
(A) 85.0. to 100.0 points = A
(B) 75.0 to 84.99 = B
(C) 65.0 to 74.99 = C
(D) 55.0 to 64.99 = D
(E) 0.0 to 54.99 = F
(2) Notwithstanding section 40(b)(1) of this rule, if more than twenty-five percent (25%) of schools are placed in the highest accountability category, then the scale for each accountability category outlined in section40(b)(1) of this rule shall be raised by 2.5 points for the following accountability year, and each year after, until the minimum score to receive an A is 90.00.
(c) The accountability category placement for an assessed grade span is subject to the following:
(1) The grade 3, grade 4 through 8, and grade 10 assessed grade spans, must have at least ten (10) eligible students enrolled during the accountable year to be placed in an accountability category.
(2) For the grade 12 assessed grade span:
(A) the grade 12 cohort must have at least ten (10) students during the accountable year to be placed in an accountability category.
(B) to determine a final mandatory statewide annual assessment score, the assessed grade span must include at least 10 eligible students in both English/language arts and mathematics, separately, during the accountable year.
(3) As set forth in section 44 of this rule, placement in an accountability category is determined by the final numeric rating for the assessed grade span.
(d) The accountability category placement for a school or school corporation is subject to the following:
(1) A school or school corporation must have at least thirty (30) eligible students during an accountable year to be placed in an accountability category.
(2) If a school or school corporation has at least ten (10) but less than thirty (30) eligible students during an accountable year, its accountability category placement will be based on a cumulative aggregate.
(e) If a school or school corporation has:
(1) fewer than ten (10) eligible students for an accountability year; or
(2) fewer than thirty (30) students for an accountability year and no preceding accountable years with data to calculate a cumulative aggregate;
its accountability category is "null".
