Sec. 14. "Eligible performance only student" means a student who:
(1) was enrolled in grades 4 through 8 at the school, when determining the final numeric rating for a school and the assessed grade spans within a school, or the school corporation, when determining the final numeric rating for a school corporation and the assessed grade spans within a school corporation, for at least one hundred sixty-two (162) days in the accountable year or ninety percent (90%) of the instructional days in the school calendar, whichever is least;
(2) received a valid score on the applicable mandatory statewide annual assessments for English/language arts or mathematics, or both, during the accountable year;
(3) did not receive a valid student growth percentile based on their performance on the mandatory statewide annual assessments for English/language arts or mathematics, or both, during the accountable year; and
(4) was not an English learner who had been enrolled in schools in the United States for less than twelve (12) months.
