Sec. 6. "Guardian" means an individual described in IC 29-3-1-6 who:

1. (1) has been either:

   1. (A) appointed and is acting as guardian for a child, subject to the provisions of IC 29-3-8-9; or
   2. (B) identified and approved as a prospective guardian eligible to receive guardianship assistance under this rule on behalf of an eligible child; and
2. (2) meets the conditions and requirements of section 21 or 31(c) of this rule, as determined by the department.
