Sec. 15. "State guardianship assistance" means payments that are or may be made by the department pursuant to IC 31-9-2-17.8:

1. (1) to a guardian who is subject to IC 29-3-8-9; and
2. (2) on behalf of a child who is not eligible for Title IV-E guardianship assistance under 42 U.S.C. 673(d)(3).
