Sec. 5. "Adoption assistance agreement" means a written agreement between the department and an adoptive parent regarding adoption assistance, including Title IV-E adoption assistance agreements, state adoption subsidy agreements, and any agreements or court orders entered in compliance with IC 31-19-26 before its repeal. The agreement shall include:

1. (1) the amount of any payments that the department will make to the adoptive parent;
2. (2) a provision that the agreement shall remain in effect regardless of the state of which the adoptive parents are residents at any given time; and
3. (3) any applicable terms and conditions relating to continuation, termination, suspension, or future changes in the terms or amount of any payments provided under the agreement.
