Sec. 1. Facilities located in apartment buildings for persons with a psychiatric disorder or addicted individuals shall achieve a classification of prompt evacuation capability, as defined in this article, and shall comply with:

1. (1) the Indiana building code under the provisions of 675 IAC 13 in effect at the time of the initial:

   1. (A) application for licensure with the division; or
   2. (B) certification by the agency;
2. whichever is later; or
3. (2) the Indiana building rehabilitation standard, 675 IAC 12-8, for the rehabilitation of older structures.
