Sec. 1. (a) Congregate residences that are certified as sub-acute facilities may be located in or connected to buildings that have another use or occupancy.

(b) All congregate residences shall achieve a classification of prompt evacuation capability, as defined in this article, and shall comply with the:

1. (1) rules of the fire prevention and building safety commission that apply to a congregate residence under the provisions of 675 IAC 13 that are in effect at the time of the initial:

   1. (A) application for licensure with the division; or
   2. (B) certification by the agency;
2. whichever is later; or
3. (2) Indiana building rehabilitation standard, 675 IAC 12-8, for the rehabilitation of older structures.
