Sec. 10. (a) "Restraint" means:

1. (1) any:

   1. (A) manual method;
   2. (B) physical or mechanical device;
   3. (C) material; or
   4. (D) equipment;
2. that immobilizes or reduces the ability of a consumer to move his or her arms, legs, body, or head freely; or

3. (2) a drug or medication when it is:

   1. (A) used as a restriction to manage the consumer's behavior or restrict the consumer's freedom of movement; and
   2. (B) not a standard treatment or dosage for the consumer's condition.

(b) The term does not include devices, such as orthopedically prescribed devices, surgical dressings or bandages, protective helmets, or other methods, that involve the physical holding of a consumer for:

1. (1) conducting routine physical examinations or tests;
2. (2) protecting the consumer from falling out of bed; or
3. (3) permitting the consumer to participate in activities without the risk of physical harm, excluding, however, the provision of a physical escort.
