Sec. 2. (a) A referral program must operate in accordance with its submitted guidelines.
(b) The guidelines of a referral program must include the following:
(1) Names and credentials of all assessors eligible for selection in the referral program.
(2) Documentation showing that each assessor has attested to comply with IC 33-23-18-4.
(3) The establishment of a timeline, not to exceed thirty (30) days, for referrals from point of identification to referral for assessment.
(4) The designation of the location or locations where assessments may occur.
(5) A statement that the treatment providers providing services through the referral program must be certified by the division as mental health and addiction forensic treatment services providers eligible to provide services under IC 12-23-19.
(6) A description of the following services available through the referral program:
(A) Mental health services.
(B) Peer support services.
(C) Other co-occurring treatment.
(D) Ancillary services.
(7) A description of the process that will be used to refer a qualified adult to the referral program.
(8) The eligibility criteria of a qualified adult for the local referral program.
(9) A description of the administrative process for a referral to treatment, under IC 33-23-18-5, including the timeline from a court's referral to the beginning of treatment.
(10) A description of the administrative process when there is a requirement for department of correction involvement.
(11) A description of the administrative process for the treatment provider to give progress reports to the court:
(A) at least once each calendar month; or
(B) at an interval determined by the court.
(12) A description of the council's complaint and grievance procedure.
(c) The council shall make the approved guidelines available to the public on request.
