Sec. 3.5. "Health care facility" includes the following:

1. (1) Hospitals licensed under IC 16-21-2.
2. (2) Private mental health institutions licensed under IC 12-25.
3. (3) Health facilities licensed under IC 16-28.
4. (4) Rehabilitation facilities.
5. (5) End stage renal/dialysis centers.

6. (6) Any institution, building, or agency or portion thereof, whether public or private where:

   1. (A) nursing, rehabilitative, or preventive care;
   2. (B) treatment;
   3. (C) service; or
   4. (D) procedure;
7. to maintain, diagnose, or treat an individual's physical or mental condition is provided.
