Sec. 7. (a) The prenatal care provider primarily responsible for providing prenatal care to a pregnant patient shall document in the pregnant patient's medical record that the prenatal care provider provided the following to the pregnant patient:

1. (1) Information and counseling regarding human immunodeficiency virus (HIV) and the standard licensed diagnostic test for HIV.
2. (2) An HIV test.

(b) Signature by the patient acknowledging that she has been provided with the items described in subsection (a) is not necessary.

(c) The person who completes a certificate of live birth must document the following on the confidential part of each birth certificate:

1. (1) Whether a standard licensed diagnostic test for HIV was performed on the woman who bore the child.

2. (2) If a standard licensed diagnostic test for HIV was performed:

   1. (A) the date the blood specimen was taken; and
   2. (B) whether the test was performed during pregnancy or at the time of delivery.
3. (3) If a standard licensed diagnostic test for HIV was not performed, the reason the test was not performed.
