Sec. 3. Notwithstanding any other provision of this article, an individual is not eligible for the program if any of the following apply:

1. (1) The applicant is not a Medicare beneficiary.

2. (2) The individual:

   1. (A) is not domiciled in Indiana;
   2. (B) does not intend to reside permanently in the state of Indiana;
   3. (C) has not received a low-income subsidy determination from Social Security Administration;
   4. (D) has been determined eligible for full low-income subsidy;
   5. (E) is dually eligible for both Medicare and full Medicaid;
   6. (F) is an inmate of a correctional facility; or
   7. (G) is not enrolled in a Medicare Part D plan.
