Sec. 1. (a) End stage renal disease (ESRD) services refer to a fee-for-service delivery system for certain services, including admission to nursing facilities and nonemergency medical transportation (NEMT). ESRD services are covered by Medicaid within the parameters specified in this rule.

(b) The following services are not covered under this rule:

1. (1) Swing beds in a skilled nursing facility.
2. (2) Long term care services, including nursing facility, home and community based waiver, and ICF/IID services.
