Sec. 1. All fertilizer material used for hire on the property of another person for purposes of producing an agricultural crop must be used by:

1. (1) an individual that has a valid commercial applicator license; or

2. (2) an individual that:

   1. (A) has been trained as provided in section 4(b) of this rule; and
   2. (B) is operating under the supervision of a certified applicator as provided in section 4 of this rule.
